Neither Luxique nor any of its directors, officers, employees, agents or other representatives will be responsible for any claims or liable for any damages arising out of or in connection with the use of the Web site. This comprehensive limitation of liability applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, consequential or punitive damages; loss of data, information or programs on user’s information handling system; loss of income or profit; business interruption; loss of or damage to property and claims of third parties.

Accordingly Luxique makes no representations whatsoever concerning the content of those sites, makes no representations concerning its affiliation with linked Internet sites, makes no representations concerning its authorization to use any trademark, trade name, logo or copyright symbol of any linked Internet site and specifically disclaims any endorsement, authorization or sponsorship thereof. When a user links to other Internet sites off the Luxique web site, the user does so at his or her own risk and assumes all responsibility for taking protective measures to guard against viruses or other destructive elements. The “Top Table” feature on www.luxique.com is provided by toptable.co.uk Limited and is subject to the terms and conditions of toptable.co.uk Limited.

Booking Conditions:

When you reserve a room at Luxique, you will always be asked for your credit card details. Our online servers are secure. Credit card numbers are not normally stored at Luxique.

Your card details will be checked by our online system, and then sent through to the hotel as a guarantee. Where a prepayment or deposit is required, this will be clearly identified, as well as the currency in which you will be charged, and whether breakfast or tax is included. The hotel's cancellation policy will be outlined. Where you are subject to a penalty due to late cancellation or no show, the hotel shall be entitled to charge your card according to their cancellation policy.

Unfortunately we cannot GUARANTEE that you will have a good time, get a great room, enjoy your stay, or not encounter rude staff. Of course this SHOULD not happen, and we would always like to hear from you if you are unhappy, especially since we can penalize the hotel by warning future clients and travelers to avoid it. However, the only way we can make suggestions and recommendations is free from liability, and in good faith - you are encouraged to double check facilities, recommendations etc with other sources. The following is an outline of our general terms and conditions in respect of hotel bookings made on the Luxique website:

The availability and booking facilities on the www.luxique.com website are provided by Starfish Independent Travel Distribution (a Travel Intelligence company).

1. Starfish acts solely as a booking agent for the hotel(s) it books. We neither represent individual hotels, nor make any warranties as to their suitability for your stay.

2. When you book a hotel through Starfish, occasionally Starfish may charge a separate booking fee for the work undertaken in researching and booking the hotel on your behalf. These fees are clearly marked where applicable, and once paid, are non-refundable.

3. Where payment or a deposit is due in advance to a hotel or to Starfish for accommodation, this will be advised at the time of booking, and will be itemized. Where payments are made online to Starfish on behalf of the hotel, a 2% administration charge will be made, and where a credit card is used, a 3% credit card fee. This credit card fee will not apply to payments made with debit cards. For all bookings, Starfish will take a credit card number on behalf of the hotel to guarantee the reservation. In all cases, once the booking is confirmed, you are subject to the terms and conditions of that hotel’s cancellation policy. Where deposits or pre-payments are refunded on cancellation, they will be refunded less a £20 cancellation fee.

4. Hotel cancellation policies typically outline a period before check-in when cancellations will be subject to payment of a penalty. This period does not include the day of arrival - so for example a cancellation policy of '24 hours' means a reservation must be cancelled at least 24hrs before midnight of the day before arrival to avoid payment of a penalty. Similarly a cancellation policy of seven days means the booking must be cancelled by midnight of the first day of the month for a booking checking in on the 9th. Cancellations must be made by using the booking link supplied at time of confirmation, and then followed with an email or telephone call direct with the hotel.

5. Where bookings are not confirmed at the time of booking - for example where availability is shown 'on request' - any availability offered by hotels in response to a request is on a provisional basis. Rooms are not held for clients pending acceptance of an offer by a client; availability and conditions can change between the making of the offer and its acceptance by the client; and hotels reserve the right to amend or reject bookings. To avoid disappointment, offers should be accepted as soon as possible after receipt if clients wish to make a firm booking, and you will be notified by email within 24hrs whether your booking has been successful. However, it is your responsibility to contact Luxique or the hotel direct if an email has not been received, because once a booking has been made with Luxique by entering your credit card details, whether confirmed or not, you are subject to the cancellation policy of that hotel. If your check-in date is within seven days of making a request booking, or if you plan to make travel arrangements based on your request booking within seven days, you are advised to contact the hotel direct to confirm. Luxique cannot be held liable for errors or omissions in bookings made at participating hotels.

6. Luxique accepts no responsibility for the accuracy of the hotel listings published on its websites or in its newsletters and books. Reviews and descriptions are supplied by third parties and in some cases the hotels themselves, and we accept no responsibility for advice given or facilities listed. Opinions expressed are subjective. Moreover, hotel facilities may change at any time.

7. You are advised to reconfirm your hotel booking two weeks before check-in, and to let the hotel know your estimated time of arrival. If you arrive after 18.00 hours, the hotels will need to know.

8. For your security, payments online are made through secure servers.

User Conduct:

User's use of the Web site is subject to all applicable local, state, national and international laws and regulations. User agrees not to use the Web site for illegal purposes; not to interfere or disrupt the operation of Web site or networks connected to the Web site; to comply with all regulations, policies and procedures of networks connected to the Web site; not to transmit through the Web site any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature; not to transmit any material that encourages or aids and abets a criminal offense or gives rise to civil liability; or not to gain unauthorized access to other computer systems. Luxique may, in its sole discretion, immediately terminate User’s right to use the Web site should User's conduct fail to conform to the terms of use.

Proprietary Rights to Content:

User acknowledges that all content, including but not limited to text, software, music, sound, photographs, video, graphics or other material presented to User by the Web site and resident thereon is protected by copyright, trademark, patent or other intellectual property or trade secret law.

User is only permitted to use this Content as expressly authorized by the Web site and may not copy (other than page caching), reproduce, distribute, modify, or mirror this Content without the express written authorization of Luxique. User agrees not to use any meta-tags or any other “hidden text” utilizing Luxique’ name or trademarks, or the name or trademarks of any Luxique affiliate or subsidiary, without the express written consent of Luxique. Nothing contained herein shall be construed as conferring upon User any license or right under any copyright, patent, trademark or trade secret held by Luxique, its affiliates or subsidiaries.

Indemnification:

User agrees to defend, indemnify and hold Luxique, its affiliates, subsidiaries, directors, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of the Web site.

User’s continued use of the Web site constitutes an affirmative acknowledgement of and agreement by the user to abide by and be bound by the Web site terms of use. Should the user object to the Web site or the terms of use, the user's only recourse is to immediately discontinue use of the Web site.

Luxique reserves the right, in its sole discretion to terminate, change, suspend or discontinue any aspect of the Web site, including the availability of any features of the Web site, at any time. Luxique may also impose limits on certain features and services or restrict your access to parts or the entire Site without notice or liability.
